Terms and Conditions of Use

These Terms and Conditions of Use (“Terms”) govern access to and use of the Nice & Clean Floor Care and Nice & Clean Floor Care & Restoration mobile applications, related websites, and business-management systems (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms.
1. Internal Business Use Only
The Services are private business tools for Nice & Clean. Access is limited to authorized owners, employees, technicians, contractors, administrators, and other personnel who have been issued credentials by Nice & Clean.
Customers and members of the public may not register for, access, or use the internal mobile applications unless Nice & Clean expressly provides a separate customer-facing service.
2. Authorized Accounts
Nice & Clean creates, manages, changes, suspends, and terminates user accounts. You must:
- Use only the account assigned to you.
- Keep your password and device secure.
- Promptly report suspected unauthorized access.
- Provide accurate information when using the Services.
- Use the Services only for legitimate Nice & Clean business purposes.
You may not share credentials, impersonate another person, interfere with the Services, attempt unauthorized access, or use the Services for unlawful, fraudulent, harmful, or competitive purposes.
3. Company Data and Customer Information
All customer records, job information, estimates, invoices, photographs, signed agreements, schedules, notes, time records, and other information entered into or generated through the Services are business records of Nice & Clean, subject to applicable law.
Authorized users may access and use this information only as needed to perform assigned work. Users may not copy, disclose, sell, misuse, or retain business or customer information for personal purposes.
4. Time Records and Job Documentation
Users must enter time-clock, job, photograph, note, and service information accurately and promptly. Deliberately false, misleading, incomplete, or unauthorized entries may result in loss of access, disciplinary action, termination of employment or contract, and other remedies available to Nice & Clean.
Administrative users may correct time records, job records, and related business information when appropriate.
5. Service Agreements, Estimates, and Invoices
The Services may create, store, send, or display estimates, invoices, service agreements, signatures, and payment-related records. Only authorized personnel may issue, modify, send, approve, or otherwise manage these records.
A customer signature or payment record may be treated as evidence of acceptance or payment to the extent permitted by applicable law and the applicable agreement.
6. Payments
Where payment functionality is available, payment processing may be provided by Stripe or another authorized third-party processor. Nice & Clean does not control the availability, policies, or security practices of third-party payment processors.
Users may not use payment features for unauthorized transactions, fraudulent activity, or any purpose unrelated to authorized Nice & Clean business.
7. Device Permissions
The Services may request access to features such as the camera, photo library, Face ID or device authentication, notifications, and mapping applications when needed for app functionality. You may manage many permissions through your device settings. Disabling a permission may limit certain features.
8. Intellectual Property
The Services, including their software, branding, logos, designs, text, workflows, and content, are owned by or licensed to Nice & Clean or its licensors and are protected by applicable intellectual-property laws.
No license is granted except the limited, revocable right to use the Services for authorized internal business purposes.
9. Availability and Changes
Nice & Clean may modify, update, suspend, restrict, or discontinue any part of the Services at any time. We may also change these Terms when necessary. Continued use after updated Terms are posted constitutes acceptance of the updated Terms.
10. Disclaimer
The Services are provided on an “as is” and “as available” basis to the maximum extent permitted by law. Nice & Clean does not guarantee that the Services will always be uninterrupted, error-free, or available on every device or network.
The Services are business-management tools and do not replace professional legal, tax, accounting, insurance, employment, or safety advice.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Nice & Clean and its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to use of, inability to use, or reliance on the Services.
Nothing in these Terms limits liability that cannot legally be limited.
12. Termination
Nice & Clean may suspend or terminate access at any time, with or without notice, including when it reasonably believes a user has violated these Terms, created a security risk, or no longer requires access for business purposes.
Upon termination, the user must stop using the Services and return or securely destroy Nice & Clean information as directed.
13. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute relating to the Services will be handled in the state or federal courts located in Tennessee, unless applicable law requires otherwise.
